Welcome to ClapSMS ("Website"), a service provided by Papaclap Group Pty Ltd (ABN: 87 612 053 139) ("we," "us," or "our"). By using ClapSMS, you agree to abide by these Terms of Service. If you do not agree with these terms, please discontinue the use of our services immediately.

2. Service Description

ClapSMS provides an integration service between a website and the customer's Android device and/or WhatsApp account. We do not provide any telecommunication services ourselves. All SMS, WhatsApp text, media, and files sent using ClapSMS are transmitted through the customer’s own SIM cards or WhatsApp accounts. Customers are solely responsible for any messages, media, or files they send using our platform.

3. Compliance with Laws

Customers must comply with all applicable laws and regulations, including but not limited to:

  • Local and international anti-spam laws (e.g., the Australian Spam Act 2003, CAN-SPAM Act, GDPR, etc.).
  • Anti-fraud regulations enforced by relevant authorities.
  • Any media dissemination laws governing the distribution of content via digital platforms.

We reserve the right to report any unlawful activity to the appropriate authorities.

4. Opt-Out Requirement

To ensure compliance with privacy regulations and user consent laws, customers must include a clear opt-out option in all SMS, WhatsApp messages, and media files sent through our service. Failure to provide this may result in account suspension or termination.

5. Prohibition of Fraud and Spam

We strictly prohibit the use of ClapSMS for sending fraudulent, misleading, or spam messages, media, or files. If we detect that a customer is sending spam, fraudulent content, or violating applicable laws, we reserve the right to terminate their account immediately without notice.

6. AI Moderation System

ClapSMS employs an AI moderation system to monitor message content for potential spam, fraudulent activity, and inappropriate media distribution. This system is intended to enhance security and compliance with our policies. However, customers remain solely responsible for the content they send. 7. Account Termination

We reserve the right to terminate or suspend accounts without prior notice if we determine that a user has:

  • Violated any terms stated in this agreement;
  • Engaged in spamming, fraud, or unlawful activities;
  • Failed to comply with local anti-spam, anti-fraud, or media distribution regulations.

8. Limitation of Liability

ClapSMS is provided on an "as is" basis without warranties of any kind. We are not liable for:

  • Delays or failures in message delivery due to third-party telecommunication providers;
  • Any legal consequences arising from a customer’s misuse of the service;
  • Loss or damage resulting from account termination due to violations of these Terms.

9. Changes to the Terms of Service

We may update these Terms of Service from time to time. The latest version will always be available on our website. Continued use of ClapSMS constitutes acceptance of any modifications to these terms.
